Booking and Stay Terms and Conditions

1. Identification and scope

Madalena Hostel & Suites, located at R. Conselheiro Bivar 109, 8000-255 Faro, is operated by Hélio Diogo Unipessoal, Lda, company number 515291048, with registered office at Edifício One, R. das Pimenteiras 8 Loja 1, Vilamoura, 8125-473, holder of Local Accommodation registration no. 158010, hereinafter referred to as “Madalena Hostel”.

These Terms and Conditions govern direct bookings made through the website, by email, telephone or another direct Madalena Hostel channel, as well as the rules of stay. Bookings made through external platforms are also subject to the conditions shown and accepted on that platform. If there is a discrepancy regarding price, payment or cancellation, the specific conditions of the rate and channel through which the booking was completed prevail, without prejudice to mandatory legal provisions.

2. Booking and confirmation

2.1. A booking is only confirmed after the guest receives written confirmation from Madalena Hostel or the booking channel used.

2.2. The confirmation identifies, among other things, the dates, room or bed type, number of guests, price, taxes and charges known at the time of booking, payment terms and applicable cancellation policy.

2.3. The guest must check the confirmation details and report any error as soon as possible.

2.4. Prices and minimum stays may vary according to dates, availability, occupancy, room type and selected rate. A later price change does not affect an already confirmed booking.

2.5. Special requests, including a specific bed, accessibility, extra cleaning, daily towel and linen changes or early check-in, require express confirmation and may carry an additional charge.

3. Guests and occupancy

3.1. The person responsible for the booking must be at least 18 years old, have legal capacity to contract and stay at the hostel during the booking.

3.2. The number and identity of guests must match the booking. The booked capacity may not be exceeded and the booking may not be transferred without prior permission.

3.3. The hostel is exclusively for guests aged 18 or over. Minors and children are not accepted, even with an adult. The minimum age applies to private rooms and shared dormitories. Valid identification may be requested at check-in.

3.4. Madalena Hostel may refuse accommodation to people not included in the booking where this breaches capacity, safety or the agreed conditions.

4. Price, payment and tourist tax

4.1. The total price and payment schedule are those shown before booking confirmation.

4.2. Accepted payment methods are card, bank transfer and/or cash. Madalena Hostel will never request full card details by ordinary email.

4.3. The municipal tourist tax applicable in Faro may be charged when legally due. Its amount, exemptions, maximum number of nights and collection timing are those set by the current municipal regulation and, whenever possible, shown before the booking is completed.

4.4. Additional optional services, subject to availability and prior confirmation: extraordinary suite cleaning, €25 per service; daily towel and/or bed linen change, €5 per day; same-day luggage storage (09:00–17:00), €2 per bag; overnight luggage storage, €5 per bag per day; shower after check-out, €5 per person. Payment must be made in cash directly to the team unless otherwise stated.

5. Security deposit

5.1. A €25 deposit per person may be required and communicated before the booking is completed or, where this is not possible, before check-in.

5.2. The deposit is used solely to secure amounts justifiably due for damage, loss of hostel property or a breach attributable to the guest.

5.3. If no amount is deducted, the deposit will be released or returned by the same payment method, where technically possible, within seven days after check-out. Bank processing times may vary.

5.4. Any deduction will be explained. If proven loss exceeds the deposit, the responsible guest must pay the difference, without prejudice to their right to challenge it.

6. Check-in and check-out

6.1. Free check-in is available from 15:00 to 18:00.

6.2. Check-in after 18:00 is always possible through self check-in, provided all required steps have been completed beforehand. If the team must attend in person outside normal hours for a reason attributable to the guest, these call-out charges may apply: 18:00–00:00, €20; after 00:00, €40. This includes failure to follow instructions, lost or unavailable access, an unreported arrival-time change or another situation requiring attendance. No charge applies where the need results from a failure attributable to the property or team.

6.3. Check-out must be completed by 10:00.

6.4. Early check-in and late check-out depend on availability, confirmation and any charge communicated in advance.

6.5. Valid identification may be requested at or before check-in, as required by law.

7. Guest identification and legal reporting

7.1. Madalena Hostel collects the identification data required to comply with legal obligations applicable to tourist accommodation.

7.2. The arrival and departure of foreign guests are reported electronically through Portugal's Accommodation Bulletin Information System (SIBA), under applicable law.

7.3. A Portuguese tax number (NIF) is collected where legally necessary or requested for invoicing. It is not a general requirement based solely on the booking value.

8. House rules

During the stay, guests must respect other guests, staff, neighbours and hostel property; observe quiet hours from 22:00 to 08:00; not hold parties or cause disruptive noise; not bring animals; not move furniture or décor without permission; not allow unauthorised visitors into guest-only areas; follow safety, hygiene and common-area rules; and not possess or consume illegal substances or endanger people or property.

Smoking, vaping or using electronic cigarettes indoors is strictly forbidden except in expressly designated areas. A breach may result in immediate removal without refund and a €200 fine, plus proven additional costs for extraordinary cleaning, odour removal, fabric treatment or damage repair.

Alcohol consumption alone does not result in removal. Entry may be refused or a stay ended where a person's behaviour presents an objective safety risk, seriously disturbs others or repeatedly breaches these rules. Where legally permitted, termination attributable to the guest may occur without refund for unused nights.

9. Cleaning, linen and room access

9.1. Standard cleaning and linen-change frequency is shown in the booking or communicated at check-in. For stays longer than three nights, sheets and towels are changed.

9.2. Additional cleaning or changes may be subject to availability and a price communicated in advance.

9.3. The guest must allow room access, with notice whenever possible, for urgent repairs, a reported issue, legal compliance or protection of people and property.

10. Damage, loss and charges

10.1. The guest is responsible for damage they cause and damage caused by minors, companions or visitors under their responsibility, subject to assessment of the circumstances.

10.2. Replacement values when items are lost, damaged or not returned: bath towel, €10; hand towel, €7; bath mat, €5; sheet set, €25; duvet, €40; locker key, €25.

10.3. Where an extraordinary call-out results from an act attributable to the guest, including lost keys or keys left inside, up to €20 may be charged if communicated and justified.

10.4. On departure, the guest must leave the space reasonably usable, place rubbish in the indicated locations and not leave unwashed dishes. Extraordinary cleaning is only charged when required by abnormal use and with justification.

11. Lost property

11.1. Found property is kept for three months, except perishable, dangerous or apparently valueless items, which may be disposed of sooner.

11.2. Return by post or courier requires owner confirmation and advance payment of shipping and packaging. Dispatch is at the recipient's risk, without prejudice to the hostel's legal responsibility in preparing it.

12. Liability

12.1. Guests must take reasonable care of money, documents and valuables and use the security facilities provided.

12.2. Madalena Hostel is not liable for loss, theft, damage or interruption caused by third parties, the guest or events beyond its reasonable control, except where liability is legally attributable to it.

12.3. Electricity, water, communications, internet or other service failures will be handled diligently but may depend on external providers. This clause does not limit legal rights or exclude liability attributable to Madalena Hostel.

13. Cancellations, changes, no-show and early departure

13.1. The applicable policy is always the one shown before booking and reproduced in the confirmation; rates may have different conditions.

13.2. Unless the direct rate says otherwise: cancellation is free up to 30 days before check-in; with less than 30 days, 30% of the total is retained; date changes requested up to 30 days before check-in depend on availability and any price difference.

13.3. For external-platform bookings, cancellation, changes, no-show and refunds follow that platform's and rate's conditions.

13.4. For a no-show or early departure, there is no refund, credit or compensation for unused nights, regardless of reason, unless mandatory law or the specific booking conditions provide otherwise.

13.5. Refunds due are processed to the original payment method where possible. Availability of funds may depend on the bank or platform.

13.6. The 14-day withdrawal right does not apply to accommodation supplied on a specific date or period under applicable consumer law.

14. Cancellation by Madalena Hostel and force majeure

14.1. If accommodation becomes unavailable due to serious failure, safety risk, authority decision, natural disaster or another cause preventing service, Madalena Hostel will inform the guest as soon as possible.

14.2. Where feasible, the guest may choose equivalent alternative accommodation, a date change or refund for services not provided. Any limitation of liability applies only as permitted by law.

15. Complaints and dispute resolution

15.1. Guests should report any issue during their stay as soon as possible so it can be resolved promptly.

15.3. These Terms are governed by Portuguese law. Any choice of jurisdiction does not affect mandatory consumer rights.

16. Changes

Madalena Hostel may update these Terms to reflect legal or operational changes. The version applying to each booking is generally the one accepted when it was made, unless mandatory law changes or the guest agrees otherwise.
